The Supreme Court is often polarized on questions related to abortion. On Wednesday, January 15th, the court heard McCullen v. The sidewalks remain open for ordinary passersby and remain open for all uses by the abortion clinics themselves including for employees conversing with patients, thus favoring one message about abortion over another. These public spaces are off limits, however, to anyone else who would use them for speech.The result is a situation that is bad for First Amendment rights, so bad in fact that the Supreme Court's 2000 decision in a similar buffer zone case has been called "slam dunk wrong" by longtime abortion rights supporter and constitutional expert Laurence Tribe. (And in that case, the law applied to all speakers at all healthcare facilities, while here it singles out only one type of facility and one point of view.) The law is also bad for women in crisis pregnancies. But often such conversations are impossible because an 80 year old woman cannot walk the zone's perimeter quickly enough. And if she enters the forbidden zone, she has committed a crime.Women deserve better, and so does the right to free speech. If we are serious about protecting a woman's "right to choose," then we ought to protect her right to engage in conversation about alternative choices on the public sidewalk.
